1. OWNERSHIP

1.1 This website (“the Website”) is a website of The Disc Jockey Association hereafter refered to as TDJA.

1.2 TDJA is not responsible for the information relating to TDJA on the Website and makes no warranty in respect of its timeliness, accuracy or availability. The information provided is subject to TDJA’s Privacy Policy which you should read before accessing such information.

2. LEGAL AGREEMENT

2.1 By entering the Website, and/or any page accessible on this site you accept, without limitation or qualification, the terms and conditions set out below (the “Terms”) without modification. By accessing and using this Website, you acknowledge that you are bound by the Terms.

2.2 If you do not wish to be bound by the Terms you should not access or use the Website.

2.3 TDJA may modify the Terms in its absolute discretion from time to time without individual notice to you. You will be deemed to have accepted any modifications if you continue to use the Website after they have been posted.

2.4 Please in any event signify that you accept the Terms by clicking I ACCEPT at the point of registration.

3. INTELLECTUAL PROPERTY RIGHTS

3.1 The Website, and all the information and graphic representations or images on it (“Content”), are owned by, or licensed to TDJA. The copyright and all other intellectual property rights in the Content are the sole and exclusive property of TDJA or its licensors.

3.2 You may view the Website on your computer screen and print its contents on your printer for your personal and non-commercial use only. For the avoidance of doubt, anything printed will form part of the Content.

3.3 Without TDJA’s written consent, you may not use, transfer, copy or reproduce any part of the Content, this Website or its source HTML code in whole or in part, in any form or by any means, electronic, mechanical or otherwise, except for the sole purpose of viewing or printing its content as set out above. This includes electronic reproduction by uploading or downloading.

5.1 Wherever you are asked to provide information in connection with the Website, you agree to provide true, accurate, current and complete details. You are not obliged to provide TDJA with any optional information requested.

impersonate another person or use a false name or a name you are unauthorised to use, or create a false identity or origin or e-mail address or try to mislead us or others as to identity or origin of any communications or to provide inaccurate or unreliable contact details;
modify, access or make available data stored on a computer or device which you have accessed through the TDJA network, when either: the owner of the data, computer or device has taken steps to prevent you from doing this; or the owner has expressed a wish that you do not do this;
make available or upload files that contain software or other material, data or information not owned by or licensed to you or collect information about others (eg. names/addresses) without their prior consent;
damage, interfere with or disrupt access to the Website or do anything which might impair its functionality;
use the Website in any way to send unsolicited (commercial or otherwise) e-mail (“Spam”) or any material for marketing or publicity purposes, or any similar abuse of either;
publish, post, distribute, disseminate or otherwise transmit, defamatory offensive, infringing, obscene, indecent or other unlawful or objectionable material or information;
make available, upload or distribute by any means any material or files that contain any viruses, bugs, corrupt data, “trojan horses”, “worms”, or any other harmful software;

TDJA has no control over, and will accept no responsibility or liability in respect of, material on any website that is not under its control. Any arrangement made between you and any third party named in or introduced to you through the Website is at your sole risk and responsibility.

7.2 The inclusion of links to Third Party Websites does not imply any endorsement of the material on them or any association with their operators.

7.3 You will not arrange for any Third Party Website to be connected to any part of the Website by way of hyperlink or otherwise without TDJA’s written consent.

8. MESSAGE AREAS/FORUM

8.1 We do not control the information provided by other users that is made available on this Website, including without limitation messages posted in our forum or other message areas (the “Forum”) and, as such, does not guarantee the accuracy, integrity or quality of such Content. You agree that you must evaluate, and bear all risks associated with, the use of any such Content, including any reliance on the accuracy, completeness or usefulness of such Content.

8.2 You acknowledge that messages posted in the Forum consists of comments left by other users and that such messages are the sole responsibility of the person from whom such Content originated. This means that you and not TDJA are entirely responsible for all Content that you upload, post, e-mail or otherwise transmit via the Forum.

8.3 TDJA is not obliged to monitor, screen, police or edit the use of the Forum although TDJA reserves the right to do so in its discretion. TDJA will respond as it considers appropriate, in its discretion, if it becomes aware of any inappropriate use of the Forum, including without limitation where:

(i) such use constitutes copyright infringement;

(ii) an user publishes, posts, distributes, disseminates or otherwise transmits, defamatory offensive, infringing, obscene, indecent or other unlawful or objectionable material or information;

(iii) we are unable to verify or authenticate any information provided via the Forum; or

(iv) we believe that a user’s actions may cause financial loss or legal liability for you, our users or us.

8.4 You acknowledge that by using the Forum you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will TDJA be liable in any way for any Content, including but not limited to, for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, e-mailed or otherwise transmitted via the Forum.

8.5 You acknowledge that TDJA does not pre-screen all Content but that TDJA and its agents shall have the right (but not the obligation) in their sole discretion to refuse or move any Content that is available via the Forum. Without limiting the foregoing, TDJA and its agents shall have the right to remove any Content that violates these Terms or is otherwise unlawful or objectionable.

9.8 Notwithstanding anything in these terms TDJA does not disclaim liability for death or injury caused by its own negligence.

9.9 TDJA reserves the right to change or remove any information or material on the Website without warning, and without prejudice to any other accrued rights, and/or make available such information or material when required to do so by law or when requested to do so by regulatory bodies or law enforcement organisations.

9.10 The DJA reserve the right to change, substitute or retract any benefits at any time without notice.

10.1TDJA reserves the right at any time to modify or discontinue, temporarily or permanently, your access to or use of the Website with or without notice.

11. VIRUS PROTECTION AND COMPATIBILITY

11.1 While certain precautions have been taken to detect computer viruses and ensure security, TDJA can not guarantee that the Website is virus-free and secure.

11.2 TDJA shall not be liable for any loss or damage which occurs as a result of any virus or breach of security. TDJA does not give any warranties as to the compatibility of the Website with your computer systems, software and/or hardware.

12. TERMINATION

12.1 TDJA may restrict your access to the Website, refuse to correspond with you, and/or remove your details from the relevant database without prejudice to any other accrued rights, without prior notice to you where:

there is a regulatory or statutory change limiting the ability to provide access to the Website;
there is any event beyond the reasonable control of TDJA preventing TDJA from providing access to the Website (for example, and without limitation, technical difficulties, capacity problems and communications failures)

Those who choose to access the Website from locations outside of the UK are responsible for compliance with local laws if and to the extent local laws are applicable.

14.2 A failure or delay by TDJA in enforcing compliance with these Terms shall not be a waiver of that or any other provision of these Terms.

14.3 None of these Terms shall be enforceable under the Contracts (Rights of Third Parties) Act 1999 by any third party.

14.4 If any provisions of these disclaimers and exclusions shall be unlawful, void or for any reason unenforceable then that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

14.5 These Terms constitute the entire agreement between you and TDJA as to your use of the Website and the Content and shall supersede any prior agreement or representation in respect thereof.

14.6 The express provisions of these Terms are in place of all warranties, conditions, terms, undertakings and obligations implied by statute, common law, custom, trade usage, course of dealing or otherwise, all of which are excluded to the fullest extent permitted by law.

14.7 Any and all notices to be given by either one of us to the other pursuant to or in connection with these Terms shall be deemed sufficiently given when forwarded by e-mail or facsimile transmission in each case addressed to you at the e-mail address or facsimile number you have given us or to us at the e-mail address or facsimile number displayed on the Website.

14.7 English law governs these terms and conditions. You submit to the non-exclusive jurisdiction of the English courts.
